NYC Woman Declined To Press Charges Against Subway Attacker ‘Because She Didn’t Want To Put Another Black Man In Jail’

A young lady in New York City declined to press charges against a violent suspect after he had assaulted her on a train because she ‘didn’t want to put another black man in jail.’

Weeks later, that same violent suspect allegedly killed a 76-year-old retired teacher.

The 23-year-old woman told the NY Post how she deeply regrets the decision not to work with police after Rhamell Burke, 32, attacked her and her friend on the subway in April.

Five weeks later, Burke allegedly shoved 76-year-old Ross Falzone down a flight of stairs to his death at a subway station.

The anonymous woman told the outlet: ‘Maybe a part of me was just like, I don’t want to put another black man in jail, but, you know, at some point, if you are a criminal, you’re a criminal, and he was scary, he was a scary guy.’

She explained how the ‘scary guy’ initially approached her and her friend on the subway and began chatting to them, but as they switched carts, he followed them, kicking her male friend in the back and pushing him before grabbing her hair by the back of her head.

‘My friend freaks out, runs away, and then he grabs me by the head and pushes my head down, trying to like maybe throw me on the ground or something.

‘But I didn’t, I resisted as much as I could. I didn’t fall, and then I immediately opened up the car and then ran towards my friend.’

‘We started running a little bit, but then thank God the cops were right there because, I mean, we kept thinking about, imagine that there were no cops, we would have had to literally run for our lives.

‘They immediately arrested him. It was shut down really fast by the cops and we respected that.’

Sounds like the police did a great job. Still, she decided against pressing charges, and I guess felt like an absolute saint in doing so.

Fast forward five weeks – Burke pushes Falzone down a staircase leading into the 18th Street subway station while wearing a psychiatric bracelet from Bellevue Hospital – from where he had been released an hour earlier.

Falzone died at the same hospital hours later after suffering a traumatic brain injury, fractured spine, and broken rib.

As they say – “mercy to the guilty is cruelty to the innocent”. This young woman thought she was doing a good deed by refusing to press charges against a violent criminal on account of his skin colour, and it resulted in the brutal death of an innocent 76-year-old man.

I’m not saying she could have predicted that Rhamell Burke would go on to kill someone weeks later, but did she really believe that someone who assaulted her for basically no reason would not go on to harm another person again? If anything he must have felt emboldened by the fact he got away with the initial assault on her and her friend.

Well anyway, what’s done is done and I’m sure she feels awful about it. Hopefully she’ll save her empathy for people who deserve it from now on.

Burke has been charged with second-degree murder and is scheduled to appear at Manhattan Criminal Court tomorrow, May 14, for his next hearing.
