Judge Throws Out Tourist’s $100,000 Lawsuit Against Taco Shop That Put Too Much Salsa On His Tacos

A tourist who took a New Tork taco shop to court after claiming their salsa left him with days of diarrhea has had his lawsuit thrown out.

German national Faycal Manz filed a $100,000 lawsuit against Los Tacos No. 1 after eating at its Times Square location in August 2024.

The tourist claimed that the restaurant’s green salsa was dangerously spicy and caused him severe physical and emotional distress.

Manz claimed the salsa caused tongue blisters, a racing heart, nausea, and gastrointestinal issues that lasted for days. Here he is showing off his “tongue blisters”:

He argued the restaurant failed to provide adequate warning labels about the salsa’s heat. Hilariously, the court actually found that the restaurant’s signage clearly labels the green salsa as “medium”. Ha! What a pvssy.

Unsurprisingly, US District Judge Dale Ho has dismissed the claims entirely, writing in his 12-page opinion that “when it comes to salsa, the spice is often the point”.

Manz admitted he did not ask staff about the spice level or even sample the salsa before eating it. The judge noted that a simple online search for Mexican food would have revealed that salsa is typically spicy.

In the end, the court determined the reaction was due to the plaintiff’s personal sensitivity to salsa rather than negligence by the restaurant.

It turns out this guy is actually something of a lawsuit tourist. The salsa lawsuit was one of three filed by Manz during his six-day U.S. trip, totaling over $20 million in sought damages.

He sued Walmart for $10 million, claiming discrimination because the store’s Wi-Fi required a domestic phone number to log in; this case was also dismissed.

He sued the NYPD for $10 million over the police response to an assault he witnessed, though reports indicate he eventually dropped this case, probably after realising how stupid it was.

I mean, talk about living the American experience? Guy goes to a Mexican restaurant and gets diarrhea for days afterwards, and then files three different lawsuits over six days. When in Rome.

No word on whether Manz was punished or countersued or anything like that, but surely there should be some kind of consequence to filing so many frivolous lawsuits. The guy is clearly a grifter trying to scam some cash everywhere he goes.
