Father Who Filmed Cyclist Kneeing 5-Year-Old Daughter Wins Legal Battle
A father who filmed a cyclist kneeing his 5-year-old daughter to the floor for blocking his path has won a legal battle after the cyclist first successfully took HIM to court for sharing the footage online.
The 5-year-old’s dad, Patrick Mpasa, took this footage during a family walk in a nature reserve in Baraque Michel, Belgium, on Christmas Day 2020:
A family was on a walk in the snow with their little girl. The father was recording the walk. A cyclist came up behind them and appeared to use his knee to knock the little girl down. The father posted the story online, and it went viral.

The father posted the footage online, and it went viral. The cyclist sued the father for defamation, claiming the backlash was so severe he couldn’t leave his house anymore.
Amazingly – the court first sided with the cyclist, ordering the father to pay the cyclist 4,500 euros in compensation.
But now, after a stupidly lengthy appeal, a court in Liege has finally seen sense and ruled out the original decision which favoured Jacques D, who is president of a local cycling club and the type of tw@t who will assault a 5-year-old girl for standing in his way.

Lawyer Jacques Englebert, who represented Mr Mpasa, told the Daily Mail: ‘In essence, the court said that posting the video was a freedom of expression and it was not a crime, so the original ruling was overturned.
‘The court said that by uploading the clip, the father had contributed to the public debate on cyclists and pedestrians, and it was not an issue.’
Amazing that they didn’t come to that conclusion the first time, but better late than never. He’s lucky the kid’s dad didn’t beat the sh1t out of him right there and then, imagine how invincible he must have felt to then have the court (originally) rule in his favour too?
Even with the ruling reversed, you could argue that Jacques D. got off lightly. He was ordered to pay €2,040 in court costs, a “symbolic” €1 to the family (?) and received a suspended sentence for unintentional assault and battery on the 5-year-old.
